Florida is a judicial foreclosure state. That means all foreclosures must be processed through the court system.

The foreclosure process begins when a lender files a civil complaint against a homeowner, sometimes after the owner has missed only 2-3 mortgage payments. The property owner is then served foreclosure papers and must respond within 20 days.

Unfortunately, approximately 95 percent of homeowners simply do not answer the complaint, either voluntarily vacating the property or ignoring the notice, believing the lender will not follow through with the lawsuit since they are working on a loan modification.

If the homeowner fails to answer within the allowed time frame, the lender can then move for a summary judgment. If the judge rules in the lender's favor, the court sets a date to sell the home at auction, usually 25-35 days from the hearing. At this point the homeowner has no leverage to negotiate with a lender.

The lender cannot take your home until the court enters final judgment against you and your home has been sold at a judicial sale.
