The Mediation Process
Mediation is common in civil court cases. In this process, the homeowner and his or her lawyer meet with the lender's representative, who has the authority to settle the case and reduce the loan principal. A neutral third party acts as the mediator while the parties negotiate in good faith, trying to reach a workable resolution.
Changes on the Horizon
In April 2009, the Florida Supreme Court Task Force on Mortgage Foreclosure Crisis met to generate ideas to deal with the mounting foreclosures in the state. The group made the following recommendations for mediation prior to final hearing or trial:
- The homeowner must meet with a certified mortgage counselor
- The homeowner must provide financial disclosure to the counselor, which will then be sent to the lender
- The lender, upon request, must provide evidence of the loan history, of the current appraisal and that it owns and holds the mortgage
- At mediation, the lender's representative, who must be present or on the phone, must have full authority to settle the matter
